1. ACCEPTANCE OF TERMS
Welcome to Tranquil Mind. By accessing our website at TranquilMind.IO, participating in our courses, attending retreats, or using any of our services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
Tranquil Mind is a 501(c)(3) nonprofit organization dedicated to providiing guidance and education based on the original teachings of the Buddha.
2. DESCRIPTION OF SERVICES
Tranquil Mind provides the following services, all offered on a donation basis:
- Online meditation courses and instructional content
- One-on-one meditation guidance and instruction
- Small group Zoom retreats
- In-person meditation retreats
- Educational materials, videos, and written guides
- Weekly check-ins with qualified teachers
- Access to meditation resources and suttas
3. ELIGIBILITY
Our services are available to individuals of all backgrounds and experience levels. Users under the age of 18 should have parental or guardian consent before participating in our programs.
4. USER RESPONSIBILITIES
By using our services, you agree to:
- Practice the meditation techniques as instructed
- Be honest about your practice experience with teachers
- Maintain consistent practice before requesting guidance
- Follow through on suggestions provided by teachers
- Respect the time and effort of our volunteer teachers
- Refrain from combining our instruction with other meditation methods simultaneously without discussing with your teacher
- Keep practice notes as requested for one-on-one guidance
- Inform your teacher of any significant physical or mental health conditions
5. MEDICAL DISCLAIMER
Meditation is not a substitute for professional medical or psychological treatment. While many people experience benefits from meditation practice, Tranquil Mind does not make medical claims about meditation, nor does it provide mental health services. Please consult your medical professional as needed.
You should:
- Consult with your healthcare provider before beginning any meditation practice, especially if you have physical or mental health conditions
- Continue any prescribed medical treatments
- Seek professional help for serious physical or mental health issues
- Notify your teacher of any unusual experiences during meditation
Tranquil Mind teachers are meditation instructors, not medical or mental health professionals. Our guidance is limited to meditation technique and practice.
6. INTELLECTUAL PROPERTY
All content provided by Tranquil Mind, including but not limited to course materials, videos, written guides, presentations, and instructional content, is protected by copyright and other intellectual property laws.
You may:
- Use materials for personal meditation practice
- Share links to our website and resources
- Reference our teachings with proper attribution
You may not:
- Reproduce, distribute, or sell our course materials commercially
- Claim our content as your own
- Modify our materials and present them as official Tranquil Mind teachings
- Use our materials to create competing commercial meditation programs
7. DONATION-BASED MODEL
All Tranquil Mind services are offered freely on a donation (dana) basis, following the Buddhist tradition. There is no requirement to donate to receive instruction.
Donations are:
- Completely voluntary
- Tax-deductible as allowed by law (501(c)(3) organization)
- Used to support our mission of teaching meditation
- Not refundable once made
We cannot and will not provide meditation instruction, access to teachers, or priority treatment in exchange for donations. All students receive equal access regardless of financial contribution.
8. WHAT WE CAN AND CANNOT HELP WITH
We will work with students who:
- Show commitment through daily practice
- Try the instructions before asking questions
- Keep practice notes
- Are honest about their practice
- Are willing to receive and apply feedback
- Follow through on teacher suggestions
We cannot effectively help students who:
- Have not practiced but expect results
- Are simultaneously practicing multiple conflicting meditation methods
- Seek only intellectual understanding without practice
- Practice inconsistently then express frustration
- Are unwilling to temporarily set aside other techniques
9. TEACHER-STUDENT RELATIONSHIP
Our teachers and/or guides are volunteers who have extensive personal practice and training. The teacher-student relationship is based on:
- Mutual respect and honesty
- Regular communication about practice
- Confidentiality regarding personal practice discussions
- Non-attachment to outcomes
- The student’s autonomous practice
Teachers may decline to work with students who are not practicing consistently or who are not following the method as taught.
10. RETREAT POLICIES
For in-person and online retreats:
- Registration may require advance notice
- Participants must commit to the full retreat schedule
- Retreat guidelines (noble silence, precepts, schedule) must be followed
- Medical conditions should be disclosed prior to retreat
- We reserve the right to dismiss participants who disrupt the retreat environment
- Retreat donations are separate from general donations and help cover facility costs
11. PRIVACY AND CONFIDENTIALITY
We respect your privacy. Personal information shared with teachers during one-on-one guidance is kept confidential. We may collect basic contact information for retreat registration and course access.
Practice experiences shared in group settings should be kept confidential by all participants.
We will never sell or share your personal information with third parties except as required by law.
12. ONLINE CONTENT AND ZOOM SESSIONS
When participating in online courses or Zoom sessions:
- You are responsible for your internet connection and device
- Recording sessions without explicit permission is prohibited
- You should maintain a respectful environment free from disruptions
- Video may be required for some sessions but can be discussed with teachers
- We are not responsible for technical difficulties that prevent access
13. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Tranquil Mind, its directors, officers, teachers, volunteers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.
This includes but is not limited to:
- Physical or psychological discomfort arising from meditation practice
- Decisions made based on meditation experiences
- Technical issues preventing access to online content
- Any outcomes or lack of outcomes from meditation practice
14. MODIFICATIONS TO SERVICES
We reserve the right to:
- Modify or discontinue any service, course, or retreat
- Update course content and teaching methods
- Change retreat schedules or locations
- Assign different teachers as needed
We will make reasonable efforts to notify users of significant changes.
15. TERMINATION
We reserve the right to terminate or suspend access to our services for users who:
- Violate these terms and conditions
- Behave in ways harmful to other students or teachers
- Misuse our intellectual property
- Engage in harassment or abusive behavior
16. AFFILIATION WITH DHAMMA SUKHA AND BHANTE VIMALARAMSI
Tranquil Mind teaches the TWIM method as taught by Bhante Vimalaramsi and Dhamma Sukha Meditation Center. We maintain connections with Dhamma Sukha but are an independent 501(c)(3) organization.
17. CHANGES TO THESE TERMS
We may update these Terms and Conditions periodically. The “Last Updated” date at the top of this page indicates when changes were last made. Continued use of our services after changes constitutes acceptance of the revised terms.
18. GOVERNING LAW
These Terms and Conditions are governed by the laws of the United States. Any disputes arising from these terms will be resolved through good faith discussion and, if necessary, meditation and arbitration in the spirit of the Buddhist precepts.
19. SEVERABILITY
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
20. ENTIRE AGREEMENT
These Terms and Conditions constitute the entire agreement between you and Tranquil Mind regarding the use of our services.
